Terms of Service

Welcome to Mythium. These Terms of Service ("Terms") govern your access to and use of the Mythium mobile application ("App") operated by AI Future Progress ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be 18 years of age or older to create an account and use Mythium. By registering, you represent and warrant that you are at least 18 years old. We reserve the right to request verification of your age and to terminate accounts that do not meet this requirement.

2. Account Registration and Conduct

2.1 One Account, One Character

Each person may maintain only one account. During the current version of the App, each account is limited to one character. Creating multiple accounts or circumventing this restriction may result in suspension or termination.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at ghallad@mythium.app if you suspect unauthorized access to your account.

2.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3. Content Policy

Mythium maintains a PG-13 content standard. All user-generated content, character profiles, messages, and AI-assisted writing must comply with this policy.

Character profiles, including names, backstories, personality descriptions, and genre tags, must comply with the content policy above. AI-generated portrait images are subject to the same standards.

5. AI Usage and Transparency

5.1 AI Co-Pilot

Mythium provides an AI co-pilot that assists you with in-character writing. AI-generated suggestions are clearly marked within the App. You are responsible for all content you choose to send, whether written entirely by you or based on AI suggestions.

5.2 AI-Generated Portraits

Character portrait images are generated using AI image generation technology. These images are subject to generation limits (currently 5 per day, 30 per week) and must comply with our content policy.

5.3 AI Limitations

AI-generated content may not always be accurate, appropriate, or aligned with your intentions. You should review all AI suggestions before sending them. We are not liable for any harm resulting from AI-generated content that you choose to publish or send.

6. Moderation

6.1 Right to Moderate

We reserve the right to review, flag, remove, or restrict any content on the App at our sole discretion. Moderation may occur through automated systems (including AI-based content moderation) and human review.

6.2 Automated Moderation

Messages and content may be automatically screened for violations of our content policy. Content flagged by automated systems may be held for review, removed, or result in account restrictions.

6.3 Reporting and Appeals

Users may report content or behavior through the in-app reporting feature. We will review reports in a reasonable timeframe. If you believe a moderation action was taken in error, you may appeal by contacting ghallad@mythium.app.

7. Intellectual Property

7.1 Your Content

You retain ownership of the creative concepts behind your characters, including original backstories, personality traits, and other creative elements you author. By posting content on Mythium, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and transmit your content within the App and for promotional purposes related to the App.

7.2 AI-Generated Content

AI-generated portrait images and text suggestions are produced using third-party AI services. Ownership and rights to AI-generated content may be subject to the terms of those services. You may use AI-generated content within the App in accordance with these Terms.

7.3 Our Content

The Mythium name, logo, design, and all original content created by us are the property of AI Future Progress. You may not use our trademarks or branding without prior written permission.

8. Termination

8.1 By You

You may delete your account at any time through the in-app account settings. Upon deletion, your profile, character data, and associated content will be removed, subject to our data retention policy described in the Privacy Policy.

We may suspend or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to:

We are not obligated to provide a reason for termination, though we will endeavor to communicate the basis for account actions when appropriate.

9. Disclaimers

9.1 "As Is" Provision

Mythium is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

You acknowledge that interactions with other users are at your own risk. We are not responsible for the behavior, content, or actions of other users, whether in character or otherwise.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AI Future Progress, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress, arising out of or related to your use of the App.

Our total aggregate liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless AI Future Progress and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your content, your violation of these Terms, or your violation of any rights of another.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at ghallad@mythium.app and attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by a recognized arbitration organization, rather than in court. You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.

12.3 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in a class action, class arbitration, or any other representative proceeding.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Delaware.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of Mythium after changes are posted constitutes acceptance of the revised Terms. If you disagree with the changes, you must stop using the App and delete your account.
